Kansas Worker’s Compensation Key Information

  • Worker’s Compensation Insurance is an insurance policy that is provided by the employer (by law) to pay employee benefits for job-related injuries, disability, or death. The present law covers all Kansas employers except for those in certain agricultural pursuits or those with a gross annual payroll of $20,000 or less. 
  • Per K.S.A. 44-557, “it is…the duty of every employer to make or cause to be made a report to the director* of any accident, or claimed or alleged accident, to any employee which occurs in the course of the employee’s employment and of which the employer or the employer’s supervisor has knowledge, which report shall be made upon a form to be prepared by the director**, within 28 days, after the receipt of such knowledge, if the personal injuries which are sustained by such accidents, are sufficient wholly or partially to incapacitate the person injured from labor or service for more than the remainder of the day, shift or turn on which such injuries were sustained.” 
  • Worker’s Compensation Insurance cannot be purchased from the State of Kansas. Instead, employers are advised to contact a Kansas licensed insurange agent, contact the Kansas Insurance Department for infromation on group-funded pools, or contact the Division of Worker’s Compensation to learn about self-insurance.

Under Kansas law, an employee is not be required to join a union or pay dues or fees to any labor union, association, or organization, as a condition of employment.

According to the U.S. Bureau of Labor Statistics’ 2020 Union Members News Release, 8.9% of Kansas employed wage and salary workers were members of labor unions in 2020. This percentage falls below the 2020 national average of 10.8%.
